Terms of Service

The service

optoutwatch scans websites from a US location and reports what it observes about consent banners, opt-out signals, required links, privacy policies and third-party services. Scans are automated and reflect a single point in time and location.

No legal advice

Reports are an automated first assessment, not legal advice. They do not state that a site conforms to any law, and they cannot replace review by qualified counsel. Whether a law applies to your business depends on facts we cannot observe, such as revenue and data volumes.

No attorney-client relationship

optoutwatch is not a law firm and does not provide legal services. Using the service, reading or sharing a report, or contacting us does not create an attorney-client relationship.

No warranty

The service and all reports are provided “as is” and “as available”. Automated scans can miss things or be wrong — for example when a site shows different content depending on location or visitor, blocks automated access, or changes after the scan. To the extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness and fitness for a particular purpose.

Your account

Keep your log-in credentials confidential. You are responsible for activity under your account. Provide accurate information, including the threshold self-declaration for each site.

Acceptable use

Only submit websites you operate or are authorized to assess. Do not use the service to overload, attack or circumvent the security of any website. Our scanner identifies itself, respects timeouts and keeps request volume moderate.

Shared reports

You decide whom you share a report with and are responsible for it. A shared report records technical observations; it is not legal advice and not a statement about the conduct of the business behind the scanned site. Recipients must not rely on it without their own legal review. Do not publish reports about websites you do not operate.

Plans and billing

Paid plans are billed monthly in advance through Stripe. You can cancel at any time; the plan stays active until the end of the paid period. Unused scans do not carry over.

Availability

We aim for the service to be available at all times but do not promise uninterrupted operation. Scans are queued and may wait while capacity is in use.

Limitation of liability

To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, or for decisions you make based on a report.

Changes

We may update these terms. Material changes are announced by e-mail at least 30 days in advance. Continued use after that date means you accept the updated terms.
